Acceptable Usage Policy

Netteffect Website Services is a web presence provider which provides technically superior, professional and responsible website services.  We are responsible to our clientele and various authorities to ensure all clients use our services and maintain website content in a responsible manner.

The following guidelines must be followed by all clients as failure to do so may result in the termination of web and email services, forfeiture of service fees and/or the application of administrative fees.

Website content which is questionable can be reviewed by an authorised Netteffect Website Services representative by contacting us with sample webpage files or a URL.

Rights of Others:

It is unacceptable to post private information about others without their consent, defaming an individual or business, or infringing upon intellectual property rights of an individual or company.

Services System and Resources:

The running of any programs in the background on our servers without prior notification including chat rooms, IRC bots, more than 1,000 email messages per day and any like process is unacceptable.

Any usage of 15% or more of our system resources is also unacceptable and may result in the termination of your account immediately and without prior written notice.  Additionally, any domain name that exceeds their allocated monthly bandwidth by 10 gigabytes may be terminated.  If you are getting close to your allocated system resource limits then please contact us to avoid interuption to your web and email services.

Netteffect Website Services maintains control and ownership of any and all IP numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

Netteffect Website Services will create backups of all user accounts.  No guarantees are made of any kind, either expressed, written or implied as to the integrity and success of these backups.  Backups are made for Netteffect Website Services system configurations only.  It is the sole responsibility of the client to maintain and create backups of their code, settings, and web content.  If a loss occurs due to an error by Netteffect Website Services we will make every attempt to recover any data up to the point of failure at no cost to the client.  However, if the loss occurred by an action of the client, Netteffect Website Services will attempt to recover the lost data from the most recent archive at the request of the client. This service attracts a fee which is calculated at $100 per hour.

Client Responsibilities:

The client is responsible for all activity arising and originating from their account.  The client is responsible for securing all data, passwords and logons for their account.  All clients are ultimately responsible for the creation, development, and maintenance of their web presence.

Unacceptable Uses/Content:

• Sending unsolicited advertising to those individuals or businesses that have no existing relationship or have no desire to receive such solicitation (spamming).

• Spamming from another source while promoting a web site hosted by Netteffect Website Services (passive spamming).

• Inundating a recipient with email with no intention of responding to such emails (email bombing).

• Using a return email address or similar information to hide the actual return address of the sender from the recipient of the email. (spoofing)

• The sending of unsolicited emails.

• All pornographic content and sex-related merchandising is prohibited on all Netteffect Website Services servers. This includes sites that may infer sexual content or links to adult content elsewhere.  Also prohibited are sites that promote any illegal activity or present content that may be damaging to Netteffect Website Services servers or any other server on the Internet.  Links to such materials are also prohibited.  Examples of unacceptable content or links are pirated software, hacker programs or archives and warez sites.  Netteffect Website Services will be the sole arbiter in determining violations of this provision.  If you are unsure of your actions or feel that they may constitute a violation of Netteffect Website Services policies and guidelines then please contact us.

Abuse of the Acceptable Usage Policy may result in the application of financial penalties and legal action.  Netteffect Website Services reserves the right to recover costs and damages associated with the abuse of the Acceptable Usage Policy.

Unlawful Internet Activities:

All services provided by Netteffect Website Services may be used for lawful purposes only.

Transmission, storage or presentation of any information, data or material in violation of any Federal, State or local law is prohibited; This includes, but is not limited to:

copyrighted material, distributing copyrighted material, gambling, schemes that defraud, harassment or threatening of another person, material we judge to be threatening or obscene or material protected by trade secret and other statute, drug dealing, attempting without authorisation to access a computer system (hacking), attempts to circumvent any user authentication or security of a host, network or account, Probing the security of any network, spawning dozens of processes, port scans, ping floods, forging router information, denial of service attacks, the promotion or forwarding of any know or unknown virus, any activity which results in the loss of data, time in work, or money.  Netteffect Website Services reserves the right to check any and all system files, application files, email or any other data that resides on our servers for any perceived illegal material or for any reason so deemed appropriate by Netteffect Website Services or its attorney’s.  The subscriber agrees to indemnify and hold harmless Netteffect Website Services from any claims resulting from the use of the service which, undermines the laws of the Internet or society in general.  Netteffect Website Services reserves the right to report illegal activities to any and all regulatory, administrative, and/or government authorities for possible prosecution. 

We run and intend on continuing to run a clean, legal and respectable web presence service.  Any illegal program whether executed or not will result in a violation of this policy and appropriate action will be taken.

Limitation of Liability:

Netteffect Website Services shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Netteffect Website Services' servers going off-line or being unavailable for any reason whatsoever or the corruption or deletion of any web site from one of Netteffect Website Services' servers.  All damages shall be limited to the immediate termination of service.

Netteffect Website Services shall be the sole arbitrator of what is and is not a violation of these acceptable use policies. 

Netteffect Website Services reserves the right to terminate an account at anytime and for any reason that causes harm to any of Netteffect Website Services client's web sites.  Netteffect Website Services reserves the right to delete all content and files from the account upon termination of said account.  Additionally, Netteffect Website Services reserves the right to withhold any prepaid funds for any site removed for violations of these policies.  Netteffect Website Services reserves the right to refuse, cancel, or suspend service at our sole discretion.  Netteffect Website Services reserves the right to change the Acceptable Use Policy without prior written notice or warning.  Non-enforcement of any part of the Acceptable Use Policy does not constitute consent.  Violations of the acceptable use Policy should be referred to us ASAP.

Summary:

We reserve the right to refuse, suspend or terminate services at our sole discretion.
